Onetcall srl, owner of oneTcall Services (the terms “Onetcall” or “we” or “us” or “our” or other similar pronouns used in the present Policy shall be considered as equivalent) takes your privacy matters very seriously.
Onetcall manages all your privacy information provided to us by oneTcall application or through website, in full respect of the Italian Privacy Regulations as described in D.Lgs 196-2003, in its attachments and subsequent modifications.
The site, the Licensed Application and the various oneTcall Services offered to you may be collectively named in these terms as the “Service”.
Please read the following for further information about our Privacy Policy (“Policy”). This Policy details how we receive, collect and use information in connection with our website www.oneTcall.com (the “site”), the oneTcall software (“oneTcall App”), and other products and Services provided on the www.oneTcall.com website (all of the foregoing, is named collectively as the “Service”).
By visiting this site or using our Service, you are accepting the policies and practices described in this Policy, as such Policy may be amended from time to time. Each time you visit the site or use the Service, you agree and expressly consent to our collection, use and disclosure of the information that you provide as described in this Policy.
By accepting this license, you understand and leave us your consent to collect and process your personal information for the purposes as described below in section 1.a, 1.b and 2, including but not limited to information concerning your account, your mobile device, system and application software, and peripherals, that is collected periodically to facilitate their supply of software updates, technical support and other Services to you (if any) in relation with the License Application.
By personal data process we mean the collection, recording, organization, retention, analysis, modification, selection, retrieval, comparison, use, interconnection, blocking, communication, dissemination, deletion and distribution or the combination of two or more of such operations. Personal Information will be managed through appropriate means to guarantee security and confidentiality and may also be processed through automated tools able to memorize, manage and transmit the data.
To be clear about the terminology we are using, when we use the phrase “Personal Information” in this Policy, we mean information about you that is personally identifiable, like your name, address, e-mail address, billing information, or phone number, as well as other non-public information that is associated with this personal information. When we use the phrase “Anonymous Information” in this Policy, we mean information that is not personally identifiable, or linked to your Personal Information such as aggregated information, general demographic information and IP addresses. Anonymous Information does not necessarily enable identification of individual persons.
As defined by Italian D. L.gs 196-2003, oneTcall Service does not require, manage or interact with your sensitive information.

1. Collection and Use of Information
1.a Service Purpose
If you wish to use oneTcall and/or different Services provided by Onetcall, you will be asked to create (through app and/or web form) a “User Account” by providing us with your name, phone number, email address and by selecting a password.
YOUR CONSENT FOR HANDLING OF PERSONAL INFORMATION FOR SERVICE PURPOSES AS DESCRIBED IN HERE IS MANDATORY FOR PROVIDING THE SERVICE.
Your name and email address, together with your password, will be used for accounting purposes linked to the oneTcall Services and site.
All your personal information for service purposes will be managed by Onetcall in full conformity with Italian D.Lgs 196-2003 requirements.
Your phone number will be used for identification purposes as your oneTcall user ID, your email address will be used for the log- in and for communication purposes.
Onetcall, in direct form or through support by third-parties (see section 2.4), also maintains a Call Detail Record (CDR – see https://en.wikipedia.org/wiki/Call_detail_record) for each call that goes through the system. These are industry standard records used by all phone companies. We keep this information in order to better understand network behavior and trends (number of calls made by users, typical destinations, call lengths, network type, etc.), to detect potential outages and technical problems (this helps us notice things like a drop in call volume in a certain geographical area, a change in call length, a change in typical networks, etc.) and for public safety reasons. All log analyses are conducted in an anonymous, aggregate, non-personally identifiable, manner. We may check a specific Call Detail Record following a customer request for support.
In accordance with Italian D.Lgs 196-2003 you can request your last 6 months of CDR processed in oneTcall Service, by registered mail to Onetcall Srl., to the attention of: Privacy Policy Administrator, via Nuova Poggioreale n.60L Ed.13, 80143 Napoli (Italy).
All traffic information (your phone number and CDR) may also be processed for compliance with legal obligations and public security, for the estimated time required by them. Processing may also be done to ascertain responsibility in case of hypothetical computer crimes against the site and in all cases of investigation being conducted by judicial authorities. In this case, the storage period of information on traffic will depend on the length of the investigation and inquiry activities.
Audio calls by users are transmitted either directly from user to user or, if the direct transmission is not possible (due to, for example, firewalls), oneTcall servers are used to transmit the call. In the latter case, the information transmitted is stored briefly in volatile memory (RAM) solely to enable the transmission of the call to the other user. We will NOT record any part of your call.
oneTcall may interact with your phone’s SMS, address book and call history for the sole purpose of Service activation, placing incoming messages in your inbox, reading the contents of the activation SMS sent to you by Onetcall. WE WILL NOT ACCESS THE CONTENT OF ANY OTHER SMS.
1.b Billing Purpose
If you wish to use oneTcall and/or different Services provided by Onetcall, you might be asked to provide your billing information in order to process your payment for the Service. We use third-party services to process payments and we require that these third- parties take appropriate technical and organizational measures to protect your personal and traffic data and to conform to the existing laws. Please consult the terms of use and privacy policies of such third- parties before providing your banking or payment information.
IF REQUESTED, YOUR CONSENT TO THE PROCESSING OF YOUR PERSONAL DATA FOR BILLING PURPOSES AS DESCRIBED HEREIN IS MANDATORY FOR THE PROVISION OF THE SERVICE.
By oneTcall application or through website, upon prior appropriate accounting process, you can access your personal and billing information being processed by us.
All your personal information for billing purpose will be kept by Onetcall in full accordance with Italian D.Lgs 196-2003.
1.c Forums
In the event we make message boards and forums at your disposal (collectively, “Forums”), you will be solely responsible for the information and any other content you post on and through such Forums and must be aware that when voluntarily providing Personal Information (for example, name, e-mail address, telephone number) on or through these Forums, such information is generally available to, and may be collected and used by, other users. This may result in unsolicited messages from third- parties, and such messages are beyond our control. We do not exercise control over all users or site visitors, and in no way are we responsible, nor we have any liability whatsoever, for any collection or use of information you may disclose through the Forums. This Policy does not cover such disclosure of information. You are invited to proceed with discretion when providing personal information about yourself in and through Forums. Please do not post any Personal Information on this site that you expect to keep private.
1.d Cookies, Clear GIFs and Other Automatically Collected Data
Our site uses cookies and similar technologies to grant the proper functioning of the procedures and to improve the experience of using online applications. This document provides detailed information about the use of cookies and similar technologies, how they are used by LeMaR Srl and how to manage them.
Cookies are short bits of text (letters and/or numbers) which enable the website server to memorize on the client (the browser) information to reuse during the same visit to the site (session cookies) or later, even several days apart (persistent cookies). Cookies are memorized on the basis of user’s preferences, by the single browser on the specific device being used (computer, tablet, smartphone).
Further in this document we will refer to cookies and to all similar technologies simply using the term “cookies”.
Types of cookies
According to the characteristics and to the use of cookies we can distinguish different categories:
Technical Cookies: they can be divided into “navigation cookies”, which grant the normal browsing and use of the website; “analytics cookies”, used by the site manager in aggregate form about the number of users and how they visit the site itself; “functionality cookies” which allow the user to browse on the basis of a set of selected criteria in order to improve the service provided to the user itself.
Profiling Cookies: they are cookies intended to create user profiles and are used to send advertising messages according to the preferences expressed by the user while browsing.
Our site doesn’t use its own profiling cookies.
Other instruments similar to cookies
Our website also uses local storage and session storage to improve the browsing experience.
Local and Session Storage: it is a specific object of the browser, shared by all instances (tabs or windows) opened by the user during browsing. This enables, for example, to save some data in a window, close the browser and then trace them at the next reboot, or else, to save the data in a window and read them in another one. This is true as long as the user uses the same browser. The Local Storage doesn’t allow different browsers to share data.
The difference between Local Storage and Session Storage is that while the data stored with Local Storage will be available on the whole site and held in the computer’s memory even if the user’s browser or device is turned off, the information stored with Session Storage can be retrieved inside that page or session only.
To delete the data collected with Local Storage the user will have to cancel the browser cache, otherwise this info will be available for an unlimited period.
Session Storage, on the contrary, stores the information temporarily and simply by reloading the page or turning the browser off, the user makes the collected data disappear.
Our site may use “Clear Gifs” (aka “Web beacons” or “pixel tags”) or similar technologies, in the site and/or in our communications with you to enable us to evaluate site usage information about visitors to the site, target campaigns, update tourist information and know if you have visited a Web page or received a message. A Clear Gif is typically a one-pixel, transparent image ( even though it can be a visible image as well), located on a Web page or in an e-mail or other type of message which is retrieved from a remote site on the Internet. It enables the verification of an individual’s viewing or receipt of a Web page or message. A Clear Gif may enable us to relate your viewing or receipt of a Web page or message to other information about you, including your Personal Information.
Our servers may automatically collect data about your Internet address when you visit the site. This information, known as an “Internet Protocol” address, or IP address, is a number that is automatically assigned to your computer by your Internet service provider any time you are on the Internet. When you request pages from our site, our servers may access to your IP address and, where applicable, to your domain name. Your IP address is used to identify you and to collect demographic information about our users and users in general, but does not include personal information. Our server may also record the referring page that “links you” to us (for example, another website or a search engine); the pages you visit on this site; the website you visit after this site; the advertisements you see and/or click on; other information about the type of Web browser, computer, platform, software on the computer and settings you are using; all search terms you have entered on this site or of a referring site; and other Web usage activities and data recorded by our servers. We will not link any Personal Information, including e-mail addresses, with aggregate data of our users.
Our service providers, among which, for example, our analytics suppliers and our e-mail management partner, may perform any or all of these activities regarding the site usage information on our behalf.
Cookies Duration
Some cookies (Session cookies) remain active only until the browser is closed or until the logout command is executed. Other cookies “survive” the browser closure and are also available the next time the user visits it.
These cookies are called persistent and their duration is fixed by the server at the moment of their creation. In some cases an expiration date is fixed, in other cases the duration is unlimited.

2. Sharing and Disclosure of Information

Onetcall will always require these third-parties to take appropriate organizational and technical measures to protect your personal data and traffic data and to observe the relevant legislation.

2.1 We may use third-party companies in order to send you an authentication SMS when you register with oneTcall. In order to send you the SMS, we send one of these third-party companies your phone number and the authentication message. These third-parties are contractually obligated only to use your phone number for the transmission of the authentication SMS.
2.2 If we fail to send you an SMS (this happens in certain cases) you may ask us to call you and read you the authentication code on the phone. This is done using a third-party automated phone system. In order to call you, we provide this third-party partner with your phone number and send the “audio content” of the call to them. The third-party partner in turn will typically use another phone provider who may use another phone provider and so on until the call reaches you. This is an industry standard mechanism for the transmission of phone calls. The third-party partner is contractually obligated only to use your phone number for the completion of the authentication phone call.
2.3 We may use Push Notification Services to notify you about various events related to the app. If we do so, the phone number or the name of the person calling you or sending you a message may be part of the notification. This message is sent to the push notification service provider, for delivery to your device.
2.4. We may use third-parties to process and route the VoIP traffic generated by your account. In order to manage the calls, we provide this third-party with your phone number and with the phone number of your calling parties. The third-party partner in turn will typically use another phone provider who may use another phone provider and so on until the call reaches the destination. This is an industry standard mechanism for the transmission of phone calls. The third-party partner is contractually obligated to only use your personal information for the completion of the phone call.
2.5. We use third-parties to process the payment and/or billing information that you submit on our site or through the oneTcall App to facilitate payment transactions.
We require that these third-parties take the appropriate technical and organizational measures to protect your personal and traffic data and to comply with relevant laws, but we are not liable or responsible for these third-party transactions. Therefore, you should review such third-party terms and conditions before providing your payment or billing information

We may also use the oneTcall software to keep you up to date with news about our software and products that you have purchased and/or to inform you about other oneTcall products and related information.
3. Children’s Privacy
oneTcall websites and software clients are not intended for, or designed to, attract anyone under the age of 18 and we do not intentionally or knowingly collect Personal Information on our sites from anyone under the age of 18 (or older in some jurisdictions). We encourage parents to be involved in the online activities of their children to ensure that no information is collected from a child without parental permission.
4. Security
We take reasonable precaution to protect Personal Information from misuse, to protect them against loss and unauthorized access in accordance with Italian D.Lgs 196-2003. Although we cannot guarantee that Personal Information will not be subject to unauthorized access, Personal Information is stored on our servers and protected by secured networks to which access is limited to a few authorized employees and personnel. 5. Business Transitions
In the event that we go through a business transition, such as a merger, acquisition by another company, or sale of all or a portion of our assets, Personal Information will likely be among the assets transferred.
